
“The trial court dismissed the claims of the Village and other
Brunswick beach communities (Caswell/Oak Island) that the
Wilmington Harbor Channel Sand Management Plan beach sand
placement and other mitigation obligations are mandatory. The
court found that the maintenance dredging beach sand placement
was discretionary and that it, therefore, lacked jurisdiction
over the claims. The Village felt and continues to feel that
the sand placement and other mitigation obligations are
mandatory and justiciable, and is considering an appeal.”
